If you live in or are visiting California and enjoy kratom, it’s important to understand the state’s unique kratom laws.
As of now, kratom is legal throughout California except in San Diego and Oceanside, where its sale and possession are banned.
Kratom’s popularity in the Golden State continues to grow as more residents turn to it for natural wellness and focus support. Still, staying informed about evolving regulations is essential for anyone who buys or uses it.
Kratom (scientific name Mitragyna speciosa) is a tropical tree native to Southeast Asia and a cousin to the coffee family. Its leaves contain natural alkaloids, that when consumed, can interact with our bodies to promote energy, focus, relaxation, or relief, depending on strain and dosage.
SHOP ALL KRATOMYes, kratom is legal in most of California, but not everywhere.
You can buy, possess, and use kratom in its natural form, throughout the state except within the city limits of San Diego and Oceanside, both of which have legally restricted kratom locally.
These bans only apply within the city boundaries. So if you’re anywhere else in California, all kratom products available on Mount Kratom are fully legal.
That said, the legal landscape is changing, not for natural kratom, but for synthetic and concentrated kratom products that artificially increase the potency of 7-hydroxymitragynine.
In August 2025, the Orange County Board of Supervisors joined several Southern California cities in banning synthetic kratom products. These bans specifically concentrated or synthetic versions of kratom containing elevated levels of 7-hydroxymitragynine (7-OH), often found in gas stations and smoke shops under flashy names.
Every batch is lab-tested for alkaloid content, purity, and safety to ensure full compliance with California law.
Here’s the current breakdown as of late 2025:
Banned:
San Diego – All forms of kratom is prohibited within city limits since 2016.
Oceanside – All forms of kratom have been banned shortly after San Diego’s ordinance.
Newport Beach – Recently enacted a ban on synthetic kratom only.
Orange County (unincorporated areas) – In August 2025, passed a ban on synthetic kratom products only.
Natural kratom remains unregulated at the state level, and fully legal everywhere else in the state.
Kratom is available across the state in local smokeshops, gas stations and online. From Los Angeles to Sacramento you will find many kratom products, but not all vendors are created equal.
While smokeshops and gas stations might offer convenience, they often carry products of questionable quality. Buying directly from a reputable online vendor like Mount Kratom ensures transparency and safety.

California’s kratom market is maturing. Local debates around safety and regulation continue, but the overall trend seems to be removing access to synthetic products rather that making a blanket ban on all kratom products.
In 2024, synthetic 7-OH products blew up. It was pushed in almost every smokeshop and gas station and they were handing it out like candy. This gave kratom vendors a clear choice; get quick profits by offering 7-OH products, or stand by the integrity of natural kratom. At Mount Kratom, we made our choice. We believe that preserving kratom in its natural form is the only path forward for the industry and for consumers who depend on it.
Natural kratom has a long record of safe, traditional use. By keeping it pure, transparent, and responsibly sourced, we’re helping to secure a sustainable future for kratom. The recent bans targeting synthetic kratom in may set a national precedent and while we don’t support bans of any kind, we’re encouraged that lawmakers are beginning to differentiate between synthetic and natural kratom.
At Mount Kratom we remain committed to upholding the highest quality standards and educating the public on safe, responsible, and natural kratom use.
