Yes — kratom is currently legal in Louisiana. On April 16, 2025, the Louisiana House Health and Welfare Committee heard HB253, a proposed Kratom Consumer Protection Act (KCPA) that would regulate rather than ban kratom in Louisiana. Despite challenges, the bill was advanced favorably with a 13-0 vote.

What Happened At The HB253 Hearing?

The hearing occurred under unusual and rushed circumstances: the bill was referred to committee on April 14th, placed on the agenda late on April 15th, and heard early the next morning—making it very difficult for advocates and organizations such as the American Kratom Association to attend.

Dr. Chris McCurdy, a well known pharmacologist and kratom researcher, attended and testified from a scientific perspective—not as an advocate. During his testimony, he referred to kratom as a “dirty drug” a pharmacological term meaning it acts on multiple receptors. While scientifically accurate, this language can be confusing to legislators and went largely unclarified, leading to potential misunderstanding and stigma against kratom.

While some members of the committee held misconceptions about kratom, there were few efforts made to correct the record, likely due to the short notice and absence of advocacy groups like the American Kratom Association. Still, the overall tone of the hearing suggested that legislators favored regulation as a middle-ground alternative to an outright ban.

What's Next?

HB253 (KCPA) is moving forward but needs public support to pass the House and Senate.

A competing bill, SB154, seeks to ban kratom entirely by classifying it as a Schedule I substance. It’s been referred to Judiciary Committee C, which has not yet posted a hearing date — and may provide only 24 hours’ notice. Which is something they’ve done in the past…
